    Terms of Use

    Last updated: September 30, 2026

    These Terms govern your use of Canary (daycarecanary.com), operated by Journey Analytics, LLC ("we," "us"). By using Canary you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Canary.

    1. What Canary is, and is not

    Canary is an informational research tool. It presents public licensing and inspection records published by the Texas Health and Human Services Commission (HHSC) and adds its own grades and incident categories to help parents and guardians understand them.

    • Canary grades are independent assessments, not official ratings. They are calculated by Canary using the method described on our methodology page. HHSC does not grade providers, and Canary is not affiliated with, endorsed by or acting for HHSC or any government agency.
    • Canary does not recommend, endorse or guarantee any provider, and does not accept payment to change a grade.
    • Canary is not a substitute for visiting a provider, asking questions, checking references and reviewing the state record yourself. Every provider page links to the official source.

    2. Accuracy and timing of data

    • Records come from the state and may contain errors or omissions we cannot detect. Canary refreshes its copy on a regular schedule (currently monthly), so there can be a delay between a state update and what Canary shows.
    • Incident categories are assigned by automated text classification of the state's own violation descriptions and can be wrong. The state's original wording is always shown alongside.
    • Business details and ratings from Google are provided by Google and not verified by us.
    • Always confirm important information with the provider and with HHSC before making a decision.

    3. Alerts

    If you watch a provider and turn on alerts, we will try to email you when its state record changes. Alerts depend on the state publishing the change and on our refresh schedule and email delivery, so they may be delayed or missed. Do not rely on alerts as your only source of information about a provider. You can turn alerts off at any time.

    4. Accounts

    You must be at least 18 to create an account. Keep your password confidential and tell us promptly about any unauthorized use. You may delete your account at any time by contacting us.

    5. Acceptable use

    You agree not to:

    • use Canary to harass, threaten or defame any provider, staff member or other person;
    • present Canary grades as official government ratings, or alter them when quoting or sharing;
    • scrape, bulk-download or redistribute Canary's grades, classifications or compiled data for commercial use without a written license;
    • interfere with the site's security or operation, or access it by automated means that overload it;
    • use Canary in any way that violates law.

    6. Providers: questions and corrections

    Providers and parents can ask us to review a record or a grade. Requests are handled through the corrections process on our methodology page. Errors in the underlying state record must be corrected by HHSC; once corrected there, Canary reflects the change at its next refresh.

    7. Intellectual property

    The underlying state records are public. Canary's software, design, text, grades, incident classifications, guides and compilation of the data are owned by Journey Analytics, LLC and protected by law. You may share links and quote individual provider grades for personal, non-commercial purposes with attribution to Canary. Google content is subject to Google's terms.

    8. Disclaimer of warranties

    Canary is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that grades reflect the actual quality or safety of any provider, or that the service will be uninterrupted or error-free.

    9. Limitation of liability

    To the fullest extent permitted by law, Journey Analytics, LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any decision made or not made based on information shown on Canary, including the choice of a childcare provider. Our total liability for any claim relating to Canary is limited to one hundred U.S. dollars ($100).

    10. Indemnity

    You agree to indemnify Journey Analytics, LLC against claims arising from your misuse of Canary or your violation of these Terms.

    11. Changes and termination

    We may update these Terms; the date above shows the latest version, and material changes will be emailed to account holders before they take effect. We may suspend access for violations of these Terms. You may stop using Canary at any time.

    12. Resolving disputes informally first

    Most concerns can be settled quickly. Before filing any lawsuit about Canary or these Terms, you agree to email info@journeyanalytic.com with the subject "Dispute notice," your name and contact information, and a description of the issue and the outcome you want. We will do the same before filing any claim against you. Both sides agree to try in good faith to resolve the matter for 30 days after the notice is received. If it is not resolved, either side may proceed under Section 13. Deadlines for bringing a claim are paused during the 30 days.

    This step does not apply to requests for emergency court orders to stop unauthorized access to or misuse of the site, or to claims that qualify for small claims court, which either side may file at any time. Requests about a provider's record or grade go through the corrections process, which usually resolves them faster.

    13. Governing law

    These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Collin County, Texas.
